Welcome to TenantWiseApp! These Terms of Service ("Terms") govern your access to and use of our website at https://tenantwiseapp.com, applications, portal, and software services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Account Registration and Security

To access the TenantWiseApp console, you must register for an administrator, staff, or renter account. You agree to provide accurate, current, and complete details during registration. You are solely responsible for maintaining the confidentiality of your credentials.

We highly recommend enabling Multi-Factor Authentication (2FA) via SMS, TOTP Authenticator, or Passkey within your profile settings. You must immediately notify us of any unauthorized use of your account.

2. Plaid Integration & Authorization

TenantWiseApp partners with Plaid, Inc. to link bank accounts and verify your identity details. By using Plaid, you grant us and Plaid the authority to access, query, and transmit your data from your financial institution.

You agree to provide true, accurate, and complete credentials for your bank accounts. You acknowledge that Plaid's processing of your information is subject to the Plaid Privacy Policy (https://plaid.com/legal).

3. Identity Verification Disclosures

We use third-party biometric and identity checks (including Plaid IDV) to verify your government IDs and check for fraud. You consent to the collection and verification of your driver's license, passport, or state ID, along with real-time selfie check scans.

TenantWiseApp does not store raw biometric information, but we retain record references of verification statuses and results. Providing forged or manipulated identity materials constitutes a material breach of these terms.

4. Use of Services & Custom Domains

TenantWiseApp grants you a limited, non-exclusive, non-transferable, revocable license to access the Services. If you configure a white-label custom domain pointing to our infrastructure (`domains.tenantwiseapp.com` or `domains.tenantwise.co`), you represent and warrant that:

  • You own or hold valid administrative permissions for the designated domain name and any associated CNAME DNS record.
  • The domain content and structure comply with local laws and housing regulation requirements.
  • You will not use custom domains to engage in phishing, fraud, or brand impersonation.

5. Tenant Screening & Applications

Landlords and Property Managers using TenantWiseApp to request applicant screenings represent that they have obtained prior, explicit, written authorization from applicants in compliance with the Fair Credit Reporting Act (FCRA).

Tenant applicants agree that all information supplied in application forms, rent history references, income stubs, and identity validations is truthful and accurate. Providing false documentation constitutes grounds for immediate account suspension and application rejection.

6. Billing, Fees & Subscriptions

Subscription plans, service upgrades, custom screening fees, and transaction charges are handled via Stripe. Fees are billed in advance and are non-refundable unless explicitly specified. Failed subscription renewals will restrict administrator console access until card details are updated.

7. Prohibited User Conduct

You agree not to engage in any of the following prohibited activities while using our Services:

  • Attempting to bypass security systems, scan vulnerabilities, or reverse-engineer our application endpoints.
  • Using automated scrapers, bots, or crawlers to harvest platform listings or application statistics.
  • Uploading files that contain viruses, trojans, malware, or corrupted data.
  • Falsifying reference emails or phone numbers to cheat application approvals.

8. Vulnerability Scanning, Security Audits, and Restrictions

TenantWiseApp actively monitors its infrastructure for threats and performs routine internal vulnerability scanning. However, you are strictly prohibited from conducting unauthorized security testing, penetration testing, port scanning, vulnerability assessments, or stress testing (such as Denial of Service attacks) on any of our endpoints, servers, custom domains, or subdomains without prior, express written authorization from our security team.

Any unauthorized scanning or testing is considered a security incident and a violation of federal law (including the Computer Fraud and Abuse Act). We reserve the right to report such incidents to law enforcement and seek damages.

9. Sharing Data with Partners, Affiliates, and Subsidiaries

To maintain, deliver, and optimize the Services, TenantWiseApp shares user data with our trusted third-party partners, integrated verification modules (e.g., Checkr, Plaid, Truv), and our corporate group, parent company, affiliates, and subsidiaries.

These transfers are governed by data protection agreements that enforce safety compliance, restrict misuse, and prevent partners from sharing data outside of the scope of services provided.

10. Term & Termination

These Terms remain in effect until terminated by either you or TenantWiseApp. TenantWiseApp reserves the right to suspend or terminate your access to the Services at any time, with or without cause, including if we believe you have violated these Terms or engaged in fraud.

11. Disclaimers & Warranties

The Services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, TenantWiseApp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Services.
  • Any screening outcome, background check report, or lease verification processed through our partner APIs.
  • Any DNS propagation delays, CNAME verification statuses, or custom domain outages.

13. Indemnification

You agree to defend, indemnify, and hold harmless TenantWiseApp and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Services, or your violation of these Terms.

14. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of them shall be governed by and construed in accordance with the laws of the State of Arizona, without giving effect to any choice or conflict of law provision or rule.
